Parkside’s Head of Chambers Wayne Walsh SC spoke together with Annie Chan and Tavish MacLean at a panel discussion “Asset Tracing, Recovery – Digital and Cross Border Issues for 2023” at the Hong Kong & China: 10th Annual International Arbitration & Corporate Crime Summit – A Glimpse into the Future 2023 on 14 December 2022.

Wayne shared with the audience his views on developing trends in crypto assets, such as cryptocurrencies, stable coins and NFT, and on developments in asset recovery including for tracing, freezing orders and orders for recovery. Wayne shared a case study of ‘pig-butchering’ with unidentified fraudsters stealing bitcoin from an investor which led to freezing and recovery orders against a crypto exchange holding the wallet for the bitcoin located outside the jurisdiction. The recent loss of mutual legal assistance (MLA) arrangements with certain countries and its impact on criminal asset recovery was also discussed.
