The Department of Justice dropped a high-profile manslaughter case against two public hospital doctors on 29 August 2023. Deanna Law, instructed by Messrs Howse Williams, acted for Dr Lam Chi-kwan and Dr Chan Siu-kim who each faced one count of gross negligence manslaughter over the death of a patient 6 years ago who succumbed to severe liver failure. This was the first case in Hong Kong’s history in which public hospital doctors were charged with gross negligence manslaughter. The Department of Justice withdrew charges after consideration of the Prosecution Code. The issue of defence costs arising from the withdrawal will be dealt with in due course.
