On 12 December 2022, the Court struck out an Action against the ListCo in which it was alleged to have denied the rights and interest of one of its shareholders by refusing the said shareholder’s deposit of shares into CCASS for trading.
In striking out the Action, the Court made clear that it had no hesitation to conclude it was an abuse of process for the Action and the former action also brought by the same plaintiff against the ListCo are materially duplicitous. Indemnity costs were awarded.
The ListCo is yet to make an announcement in this regard.
