On 30 April 2021, Paul Lam SC (assisted by Dexter Leung) delivered a virtual talk to members of the Association of China-Appointed Attesting Officers covering a range of topical conflict of laws issues between the Mainland and Hong Kong SAR.

The presentation dealt with legal issues (both substantive and procedural) relating to interim measures in Hong Kong SAR in aid of Mainland litigation and arbitration; recognition and enforcement in Hong Kong SAR of Mainland judgments and arbitral awards; commencing legal proceedings in Hong Kong SAR against Mainland entities and individuals; and Mainland legal experts.

The talk referred to a number of recent legal developments (for example, the Arbitration (Amendment) Bill 2021 which will take effect on 19 May 2021 to implement part of the Supplemental Arrangement Concerning Mutual Enforcement of Arbitral Awards between the Mainland and Hong Kong SAR) and provided an overview of recent court decisions in Hong Kong.

The talk also included various practical tips.

In view of the current public health considerations, over 280 members of the Association tuned in to the virtual talk and presentation by way of Zoom.

Members of the Association are qualified Hong Kong solicitors who have been appointed by the Ministry of Justice of the People’s Republic of China to attest and certify documents in Hong Kong SAR for use in Mainland China.
