Mr. Ernest Ng, instructed by Tanner de Witt, represented one of the Defendants.

This is the latest episode of an effort by the Plaintiffs (claiming to act for the state of Mongolia) taken against the Defendants (notably the Former Prime Minister of Mongolia) in which injunctions were obtained in Hong Kong against the Defendants. The case revolved around a Mongolian action in which serious allegations were made including corruption and involvement in an alleged fraudulent scheme in respect of two major mines in Mongolia.

The Judge struck out the Hong Kong proceedings as the Monoglian civil action has been dismissed. Also notable is the fact that the court was, in particular, satisfied that the Mongolian action was initiated by the Capital City Prosecutor’s Office without any authority, as well as finding the application was tainted by material non-disclosure before the Hong Kong Courts.
