On 13 September 2024, Frederick Chan was invited to deliver in Putonghua the 31st part of a series of Greater Bay Area lawyers’ talks (《灣區律師大講堂》第31期) organised by the Shenzhen Lawyers Association (深圳市律師協會) and Qianhai Belt & Road Legal Services Foundation (前海一帶一路法律服務聯合會) and hosted by Guangdong Chunfeng Law Firm (廣東淳鋒律師事務所) with the support of the Shenzhen City Justice Bureau (深圳市司法局), Hong Kong and Macao Affairs Office of the Shenzhen Municipal People’s Government (深圳市港澳辦), Qianhai Authority (前海管理局) and Bao’an District Justice Bureau (寶安區司法局).
The topic of the talk was recent cases and evidential requirements relating to arbitration in Hong Kong SAR (香港特別行政區民商事仲裁 – 案例新趨勢、文件與舉證). Frederick explored the recent approach of the courts in Hong Kong and other common law jurisdictions where a stay of winding-up / bankruptcy proceedings is sought in favour of arbitration. Frederick also gave an overview of recent cases where the courts in Hong Kong and elsewhere refused to enforce arbitration awards on the ground of procedural irregularity and unfairness. Frederick examined the practical implications of these recent developments.
The talk was attended by legal practitioners from a range of law firms in Shenzhen.
Frederick is an experienced counsel and arbitrator with a focus on commercial litigation and arbitration with a cross-border element / relating to Mainland China. He can conduct cases in English, Cantonese and Putonghua. He passed the Guangdong-Hong Kong-Macao Greater Bay Area Legal Professional Examination in 2021 and is a qualified GBA lawyer. He currently chairs the Mainland Affairs Committee of Parkside Chambers.
